Ebay clearly states it is illegal to sell used hearing aids. But there are many many on Ebay. So I had a chat with an Ebay rep and she/he said yeh there are lots of listings but if you sell a used hearing aid you might have your seller account shut down. Also, no one says that the buyer needs to sign a “disclaimer” saying they agree to see a prescribing audiologist before using the hearing aid. So should I take a change and in the discription say I will require the buyer to complete this form?
If the product is legal and the sale is truthful, it is not illegal. If you are licensed by your state to sell/fit hearing aids you need to include the notices and forms your state board requires for your license.
If you are an unlicensed dealer then you may run into legal problems.
If you are normally a consumer of hearing aid products, and selling your used hearing aids on ebay, as a one-time event, i doubt there is any regulation.
